What Tom Cook fails to mention is that he chose, hired and met with the appraiser when the contract required that the Lender hire the appraiser as part of the Loan process. Tom Cook is the one who breached the terms of the contract and then expected the Seller to sell the house for less when he had chosen and influenced the appraiser. My responsibility was to my client, the Seller, and not to let Tom Cook buy the house for less than market. If I had done anything unethical the Buyer and his agent would have filed a complaint against me with TREC and ABOR, which they did not do. The Buyer's agent instead tried to cover her mistakes by blaming me for taking care of the Seller, my client, and protecting him from a Buyer trying to influence the appraisal after we had agreed to sell it for the appraised value. I have nothing to hide and encourage any inquiries.

Jerry Stein was actually the listing agent of a property that I entered into a contract on. Jerry and the seller suggested (and agreed to in the contract) that since we could not agree on the price, that I pay for an appraisal on the house. If the house appraised for less than a pre-agreed on price ($335k) then the seller would sell it to me at the appraised price. If I still decided to walk away from the transaction, then the seller would reimburse me the option money and the cost of the appraisal. If it was appraised higher, then the sell would sell it to me at the pre-agreed on price of $335k. This seemed like a no lose situation. Well, the appraisal came in at $309k and the seller breached contract saying he could not sell it to me at a price lower than $325k. He then breached contract again by not reimbursing me for the option money or the cost of the appraisal ($450). Jerry did not enforce the contract that he and the seller signed. I can not recommend Jerry Stein.
