Mr. Vartan re-financed Gertrudes' home. Instead of taking at stake Gertrudes' interest, 69 years-old, he sold a loan that had a prepayment penalty, misrepresented the rate and the cash out that Gertrudes was going to get. The papers were signed without the expertise of an independent escrow agent and none of the risks were explained. He did not explain fully his commission structure. At the end of the transaction, he earned a huge commission at the expense of Gertrudes.
